Levelling Garden Slope – Should I Remove My Tree?

My garden slopes downward and I'm looking to flatten it as much as possible. This poses an issue to, what I believe to be, my non fruit bearing apple tree. We'd inevitably have to bring the soil level some centimetres up its trunk, which would probably kill it.

The tree isn't looking too healthy, however, and I wonder if it's better to try to do something to get it back to optimal health or just cut it down and plant another tree.

It seems like a waste of what is such a pretty tree. Thoughts??

Location: England, UK

Thanks!
