Client wanted the back fence replaced because it was leaning. The yard has a steep slope. We originally thought it was gravity and old age causing the fence to shift. Once we removed the fence we discovered 3' of soil was pushing the fence over. There's too much of a slope to just ignore it. A retaining wall is needed. To me, this is property damage (the fence)caused by the neighbor and future property damage/endangerment. What do you think?
