    I'm totally not understanding WHY the Judge pretending there's nothing wrong with driving while in court and the other guy smoking. This is unheard of without something being said.

    I would appeal, he’s sorta telling him that he’s not proving his case to get his evidence together ie, pictures that have the date that he cut the trees, and his text messages. Someone is lying, that’s obvious but I find it hard to believe this man would try to disrespect the court.

    She shouldn't be driving during this hearing…I believed her from the beginning..in an HOA situation you have to get a contract and be properly licensed

    I think he is trying to pull a fast one – he spoke with her and figured he could do the work, whether agreed or not, and get paid for something. Even taking both of them as telling the truth, there was no contract as there clearly was no meeting of the minds so he is out of luck. Only hire people with a contract and read the contract.

    Dude was laughing throughout the whole hearing like his case was a slam dunk and then at the end the frown was hilarious! I mean, soon as i heard there was no contract i thought it was going to be hard to prove anything else. Seemed fair to me

    Why do some judges ignore people being loud in the background during a case! It's so distracting and makes it hard to hear people while they are talking. Coughing, clearing their throat, it's disgusting.

    Hmmm. I have NEVER heard a judge be so blunt, or even really go out of their way to, explain so much and how easy the appeal process would be. As if there is something in those texts, like her saying yes to the time and date that was mentioned…. THAT WOULD make it a contract! The judge went out of his way to explain the reason for his ruling was Mr Dugas stated he did NOT THINK there was a contract, when in reallity there were. ANy LEGAL NERDS out there agree?? LOL

    Videotape everything. I had a customer who tried to claim I didn't do the work. She didn't realize that I had evidence of our conversations, and video of the work being done.

    There’s evidence she’s willing to lie. She agreed that there was an email stating the day he was going to do the work, and responded “but you were supposed to bring your license and insurance first,” not denying the content of the email. Earlier she had said he just showed up on a random day and got his saw stuck in the tree – I believe he went on the day they had agreed upon and cut down 3 trees. If he wanted to lie, he would have said he cut down all 5, wouldn’t he?

    Like the judge, I can't decide who was in the wrong because he didn't have enough evidence, not even a contract. I think the judge's ruling was just.

    She could have told her side in a few sentences. She just over did it a tad. “Where her father sleeps??”
    That’s a patient judge right there.
    Maybe he was playing Suduko just below the desk.

    This happens a lot in Australia, too, tradies for garden and fencing jobs in new-build areas using tricks to get jobs they've quoted on but not been accepted, or prices agreed. Before our house on a new-build area was finished, our soon-to-be neighbour called some contractors to quote for the fence between us. He told each we didn't want it done till our build was finished because the fence could be damaged etc. One day our neighbour got home from work and the fence posts were in cement, with a card left in his door! The contractor then insisted he'd started so he had to finish, then charged way over anyone else's price, knowing suing him was more trouble than two households going through the stress of all the tradies pulling you every which way when building a house. Utter conman.

    I do not believe the woman. I think he did the work and she wanted the trees chipped as well and took advantage of this guy. Always pays to get a signed agreement, so failing that, she lied about the work he did, said he did not do it and screwed him over!

    THE HOA DOES NOT GIVE REIMBURSEMENT ON CUTTING TREES ON YOUR OWN PROPERTY THE HOA IS FOR MAKING SURE THE NEIGHBORHOOD AND PROPERTY OWNERS KEEPS THEIR YARDS UP NOT MAKINF IT LOOK TRAHED
