The tree is probably 50-60 feet tall and 10ish feet from the walkway. He said that his sidewalk guy told him it would be fine, but I don't really trust a sidewalk guys opinion. It's only the one piece that would have the roots cut out.

It absolutely will hurt the tree. To what extent depends on the size and number of roots.
